Will I need a solicitor?

Yes, almost certainly. Buying or selling a business is a complex legal transaction and you will need to have some certainty that you are getting what you are paying for, or conversely that the payment of the price is secured and any liability after the sale is reasonable. We try to keep things as simple as possible, whilst keeping your interests protected.

Can my local firm of solicitors help me?

Not all solicitors specialise or have experience in advising on business sales. Most local / high street practices focus on residential conveyancing, divorce and wills. However, as many firms do not like to turn work away, they may well be willing to assist, but you will most likely to be advised by a property lawyer. This can mean that you may not receive the best advice, the cost is likely to be higher and the transaction may take a little longer, as our property colleagues tend to operate on a different timescale (as anyone who has bought a house may have experienced). A corporate transaction tends to move faster and need a responsive approach with more client contact than the property lawyers are used to.

But won't your fees be more expensive?

The simple answer is no. As we specialise in advising on business sales, and particularly small and medium sized business sales, our fees are very competitive and we can usually beat most quotes from most firms. Our fees are proportionate to the transaction at hand.

What will happen once we decide to go ahead with the transaction?

If you do decide to go ahead with your business purchase / sale we will come and see you to discuss the transaction and any issues or queries you may have. We will then make contact with the buyer's or seller's solicitor and begin negotiating the purchase agreement or making enquiries on your behalf. We will then advise you every step of the way to completing the transaction. We act for buyers and sellers across the UK so your location or that of the seller/buyer is not an issue.
